The terms of service contained in this document pertain to the website design process.

As used within these terms, 'NBSL', or 'NBSL Web Design' means Nightowl Business Services Ltd., and 'Client', 'you' or 'your' means you.

All prices within this site are listed in Canadian Dollars ($CDN), and do not include 7% Goods And Services Tax (GST).

Site design and all graphics created by NBSL Web Design will remain copyright NBSL Web Design.  Small, non-intrusive copyright statements and linkbacks to NBSL will be required on all sites.  If client prefers to not have these linkback or copyright statements displayed, they may be removed by purchasing the copyright at a one-time additional cost of $300.00 CDN.  Any graphics created by NBSL will contain an invisible digital 'watermark' (for copyright identification purposes).  All watermarks will be removed if client pays for the copyright.  Copyright removal costs apply to one full website only (if client has multiple sites).  Client retains any copyright to their own graphics.

Client must sign a contract and provide a 50% downpayment of the original quotation before any work will commence.  In the event that the client cancels the contract before the project is completed, the downpayment will be refunded in full.  If client has paid the downpayment by cheque, a refund cheque will be issued by NBSL, and sent by surface mail.  If client has paid the deposit by credit card, a refund will be processed on the same credit card number, within 24 hours.

If client pays by credit card, a charge by 'Nightowl Business Services Ltd.' will appear on the client's statement.

Upon completion of the project, the unpaid balance must be paid in full before the site will be released and uploaded to the client's server.

Upon payment in full, the client will also receive a copy of the entire website and all graphics on CD-ROM, which will be sent by surface mail or courier.

No work will commence before the client has given written approval of the work quotation.  No changes or additions to the quotation will be completed without written authorization from the client.

An estimated time for completion will be provided to the client before work commences.

During the website creation process, NBSL will upload a copy to its own servers, and the client will be provided with a password to access the site, and provide creative input throughout all stages of the creation process.  Once the site is released to the client, NBSL will delete the 'working' copy from its servers.

NBSL will keep a 'hard' copy of each site on CD-ROM, for archive purposes, for two years.

The client is responsible for supplying NBSL with all text wording for the site's content.

Graphics may be supplied by client.  Any graphics supplied must be the property of the client, or they must be 'public domain' graphics.  The client will be responsible for any copyright infringements resulting from the use of unauthorized graphics.

If client provides 'paper' photos to be scanned, the photos will be returned to the client. Electronic copies of any graphics must be supplied in one of the following formats:  .GIF, .JPG, .TIF, PSP or .PSD format.  We currently use CorelDraw 8, Adobe Photoshop 4, and Paint Shop Pro 7.  Graphics may be submitted by email, or on CD-R.  We do not accept copies of graphics on 3½ or 5¼-inch floppy disks.  If sending graphics by email, please compress (zip) them first.
